My husband got his labor approved this Jan and is filing for concurrent 140 & 485 for both of us. He just has a bachelor's degree which means he is EB-3 I guess. I have a MS degree and my labor is not yet approved, but should get approved in 2 months or so ( so says my lawyer) . Can we currently file for 140/485 using my husband's labor and then later also file using my labor and just wait and see which one gets processed faster and withdraw the other application. Are there any drawbacks to this - or is this even allowed ? Is there any advantage presently for EB2 over EB3 ?We live in NJ and will be filing at Vermont Service Center. Pls advice.
