1st Time H1b Stamping Help !!

Hi,

I will be going to Canada for h1 stamping (first time), I came to US in 2004 on J1 & them I transferred to H1 last year. I have 2 questions :

1) My is salary is 45K, however my pay stab is for 30K & my company payees for House rent & other benefits which adds to 45k. Is that ok. Which papers should I take to prove it.

2) I have a Non-us Degree. I have Bachelors degree from India. Is that a problem. Should I go to Canada or Mexico.

I have Visa Appointment in Montreal Consulate on Sep 28th 2006. I am applying for Canada visa next week. So its kind of urgent, I need help can some one reply me. I need to travel o India in Oct 2006.

LC salary has to match with H1B base salary. Any other amount which is not on paystub is not considered as salary. I am also assuming that your W2s from past year would not give 45K as taxable income. You will be at mercy of VO. I noticed that Montreal consulate doesn't pay much attention to LC.

However, Recently Chennai consulate have started speculating LC from what I heard. VO can't deny your VISA directly as it isnot their responsibility yet to force a company to pay you. It is always responsibility of employee to report such things to DOL. However, they are going to add new rules where it will become routine while company audit through DOL.

What VO can do is : issue 221(g) to you and ask your employer for clarification. Up on not getting response or improper justification, VO can deny your VISA. So it is a little risk unless VO doesn't notice or notices and still let you go (like in past people had long bench periods without pay and W2 doesn't add up to LC). This is not to scare you ofcourse, there are few cases I know who have got stamping without problem. So it is your choice. to clear the mess you can switch the employer :)
