The new law allows employees to change employment after filing for I-485 can change employers after 180 days. Is there any way the employer can cancel the GC processing or create problems once we change company?

Well tgia, we should wait for INS regulations to be published before making further conclusions. Seems like after 180 days a person should be safe to switch jobs, even if the sponsoring employer chooses to revoke the underlying 140 petition.

My first three years of h1b would be over by 06/01 , currently under i-485 since feb 2001. I am struggling with the decision whether to extend the h1b further to 3 more years or not. My employer feels that it is not necessary to extend the once i-485 is filed.

What I should do

You must have hit upon a very new or incompetent person because the law AC-21 was passed on 10/17/2000 and signed by president Clinton. The INS is now finalizing the guidelines. The guidelines will determine how narrowly or how liberally the law is interpreted. If you follow the murthy chat on www.murthy.com you will find a lot about it.

INS Provides Guidance on AC21 - Finally all provisions of S. 2045 gets implemented.

--------------------------------------------------------------------------------

Great news and another success for ISN efforts.

As you all know out of 4 main agenda items that ISN effort got added as amendment in S. 2045 (H1B Visa Bill), 2 were already implemented while other 2 were very much awaited by all of us. Finally that has come to reality. Finally INS published guidelines for implementing following items:

Extenstion beyond 6 years for those who have applied for Green Card atleast 1 year before 6 year limit time.

Job Flexibility for I-485 (AOS) applicants after waiting for 180 days.

Both of these items have been clarified. Read complete report at,
