I spoke to Ron today (we are transfering our case to him) and he said that 180 days count starts from RD and not ND - thought you\'d like to know...

We got RFE about company name change/merger. That jerk of our attorney didn\'t act on time (the merger happened last year before we filed I-485 but after I-140 was filed) claiming that they were hoping that INS will not catch it!!! The company is on it\'s last legs right now, and since everything is getting so complicated we decided to change attorneys and asked Ron Gotcher to handle our case which he kindly accepted. Now, this is interesting - my experience with immigration attorneys is very bad - they never want to talk to you, never return calls, never take time to explain etc. But very first time I called Ron Gotcher, he spoke to me for whole 45 minutes - and at that time I wasn\'t even his client yet!!! Very different experience indeed. Anyway, according to Ron, we don\'t have to redo I140 (which our previous attorney insisted on) but he\'ll handle the situation differently. After talking to him I am so very relieved. Gee, this turned into such a lengthy e-mail...Well, I never said I don\'t talk too much :)

Hi Maja,

I am in the same situation as you. Company name changed due to merger between 140 and 485 and the RFE suggests to either wait for regulation on the new law or to file ammended 140. I am trying to decide what to do. Would like to hear what Ron Gotcher had to say about the situation. Could you email me at mc_asu@hotmail.com?

It is better to go ahead and do a new 140 (takes 2-3 months @ present. That is what I did as per my lawyer advise. You never know how long INS is going to take to publish and implement regulations.

mc asu - It is a lot of legal stuff involved in making a decision, but it all depends of the nature of acquisition. So the best thing really is to relay on your attorneys opinion and expertise (as long as they are better than my previous attorney)
bacard_151 - I agree that the safest way probably is to redo I-140, but we are in the situation that the company will not survive long enough until new I-140 gets approved. And in situation like that, one needs somebody like Ron on their side...
