180 days or 6 months ???

Hi

I have GC since November-2008. After 10 months, that I went to India for 5 months 29 days(182), excluding departure and arrival day. Then I came back to US for 12 days and again went to back India. I stayed there for 3 months 10 days (99 days), After that till now I didn't go outside of USA. Will it cause any trouble in my CONTINUOUS RESIDENCE ? IF it does, what documents should I have to gather ? I planning to go apply for naturalization in August,2013. any trouble ?


Please give me your valuable advise.

I think I only have bank statements. Will it work ? If i don't have it, will they object it ?

Only USCIS can answer these questions and you can only get answer by actually applying.

But we can all speculate. Residence requires a physical house to live in and even if you go away that house must
be there. SO better prepare an apartment lease if you had an partment at that time.

Other documents also include your driver license (but if it has been renewed I doubt you had a copy).

You can also get a copy of credit card report . By law everyone is entitled to get a free copy from all three reporting agencies

There is not much you can do. Maybe 182 days is below threshhold so that no quesion will be even asked.
The bottomline is : you have to apply to find out what will happen. The worst case scanario is you lose
700 dollar application fee or you can just wait tow more years
 
I don't want to alarm you and if anyone finds my post to be ludicrous please do say so but if you apply for naturalization and if you get unlucky to get an IO who is picky they may find that you have abandoned your residence in the US. As far as I know the USCIS may conclude someone who has remained outside the US for over a year to have relinquished their residency here. Nevertheless, on their website USCIS does say they may arrive at that conclusion even if the person remained outside the US for less than one year.

The thing with your case is that you returned to the US 5 months and 29 days later which anyone can tell was done on purpose so you would not break the continuity thing. Then you stayed for 12 days in the US and then left again for over 3 months. You need to show USCIS that you did not go to India intending to stay there indefinitely.

Please don't make too much of my post as I might be overdoing it.
