180 days issue..Can I go on vacation with out pay for 2 months?

Hi gurus,
My company is in mood for massive layoffs. If it is required, can I take a unpaid vacation for 2 months (using EAD) and complete 180 days since AOS is applied. This way my new company can pick up my case under AC21 if required
My lawyer says this is possible. Please let me know if U or your lawyer has any say about this issue..
