My 140 was denied on ability to pay, my company which is ver very small household business refused to file the MTR/Appeal.
At present on EAD, I-485 pending.

What are my options now?

have you used all 6 years on H-1. You can apply for h-1 only thing you need to go out of u.s. and get stamped.

then start your GC process with new stable employer.

1. Just ask/convince your employer to file MTR, so that your I-140 will be pending ....

2. Based on pending I-140... file H1B with new company. ( in step 1 you will get some time for pending status )... and continue and labor again etc.

3. after step 2, ask your employer to withdraw MTR. so that he does have hassles on your case :)
