140 RFE responded Now, they say Name check pending

Hi,

My case is EB2-concurent filed on 12/23/2003 . I got RFE on 01/11/05 for I-140 (for work experience, education, education evaluation) after 2 fax enquiries and one e-mail enquiry over a period of 3 months. RFE for I-140 was recieved by uscis on 02/02/05. There were LUDs till 02/04/05 but, no change in message.

I got a response for fax enquiry which was sent in nov, 2004 on 02/02/05. It says my name check is pending and they are unable to process spouse's application as primary applicant's applicaiton is pending.

Has any one had this kind of experience? What should we do for name check? send FBI mail? Is I-140 related to Name check? I thought name check is for I-485 only?

My lawyer says that my 140 is stuck due to name check as well. It doesnt make sense because I thought name check would only hold up 485, not 140. Anyway, I'll wait another week or two and then see if we can request that they approve the 140 at least.
 
Hi Mesbah,

For everybody they r telling namecheck is pending.How long will it take for the approval??It is totally rediculous.They r holding 140 too for clearing together.Like me people are in a very bad situation(Laying off fear,8th year extension)reallly difficult situation maan.Dont know what to do!!!

I really sincerely hope your 140 approval, and mine come soon. We're both obviously very stressed out and checking this board everyday for some ray of hope. Anyway, I'm not sure how long name checks take, but obviously, it varies from a couple of weeks to a year or so.. We've both been waiting about a year already, but I guess there's no way to tell when the name check got requested. Lets wait and see if we receive anything from the FBI. I heard some people saying that they can request 140 approval and wait for namecheck in 485 stage, maybe that's an option? I don't know, but I will look into it and let u know if it's even possible.

I havn't seen or heard of name check stopping the I-140 approval, may be I am wrong but I got my I-140 approval and I sent 3-4 email and fax to FBI in oct 2004 to get the status of my name check but i couldnot get any answer from them, now the question is, is there any rule that they need to do name check before approving the I-140 because if that is so, that means whoever has got their I-140 including me, has their name check cleared :rolleyes: Well I dont think that is the case becase lot of ppl here have their I-140 approved and stuck at name check.

How do we know if I140 is name check pending

The RD for my I140 is 03/22/04. My lawyer and employer have called the BCIS 3 times over the phone Since Jan and they come to know the "Application is still pending". This morning my lawyer has initiated an inquiry through AILA.

My question

1. How do I know if my application is pending Name Check?

2. Does inquiring through AILA helps and what process does AILA follows and how much time does it takes?

I dont understand how come they can do name check for I-140 bcos in I-485 only you mention all your addresses where you lived and not in I-140 + I-140 is basically for company+individual education & experience.

Also for I-485 they are telling name check pending? so they are doing 2 times.

CSC totally fooling all of us and Dates are moving only and no progress and if you called then answer name check pending and waiting from FBI.

this is really ridiculuos and bullshit thing.

please send a snailmail to FBI. i had said earlier that it doesnt help but it doesnt hurt either...give it a shot if you have no better idea...

try congressman and they can ensure that fbi atleast has your name check request. it is possible is fell through the cracks (or well valley's creeks etc) of uscis/fbi.
