140 RFE received from Texas

Hi everyone,
I had submitted 140 in EB3 category in Texas on May 2, 2007. Online message changed to RFE issued on October 24th. My lawyer did not get the RFE. He put in a service request and they resend the RFE on December 20, 2007. Lawyer received the RFE yesterday. My worst fears have come true. The RFE is about three things: 3 year degree, experience letters and Company's ability to pay. Iam at a loss as to how to proceed with the 3 year degree. I have a 3 year degree(Physics) with 2 year post graduate diploma(Computers) from India. So do I evaluate both these degrees together or just my 3 year degree alone. Are there chances of approval with a 3 year degree evaluation? Can anyone suggest a good evaluation center? 4 years stuck in backlog to get labor cleared and now this????Please do help if anyone has any suggestions about replying to this RFE.

Exactly the same thing happened to me too at Texas 2 months ago. I filed in Feb 07 and got an RFE in july and 140 was rejected in Oct. I had same ed credentials as you. Denial notice said combination of degrees is not allowed to establish eligibility. now i am waiting for decision on appeal. I think the safest bet is to make 3 year degree equivalent to US bachelors. The only way to prove that is to get all courses you took and syllabus (from the college or university or any acceptable web site) and evaluate course by course and hours spent. This has to be very detailed. Bottom line is 120 credits are required to equate to US bachelors. I couldn't get all these details hence......starting everything all over again. Good luck to you.
