140 RFE & Indian Visit & AP using

Hi,

I have RFE on I140 for Company Tax document & my W2. My Company will reply next week. My company have around 200 H1B People and more than 100M profit.

If I140 Reject when I will in India, can I come back on AP...I do not have H1b Stamp on PP but I have h1b valid till 2007.


Anyone have any experience ?

Yes you can come back on AP but it might be risky. If your I140 gets denied they will immediately deny your 485 and hence your AP.

I think you are probably ok as long as you have valid H1b approval. you can come back after getting your passport stamped abroad even if your I140 is denied.
