140 revoked and 485 pending ...

Hello Gurus, I need your input and experiences.
My 140 was approved in June 2003. (ND Nov 2002 with labor substituion).
485 ND - jan28 and RD - Feb4. I did my 2nd FP Oct 6th.
I am sure my employer will send a 140 revocation after the conversations we had recently. I used AC21 even though i didnt send any letter to date to CIS in sep2003 after 7 months of 485 rd to join a different company. My salary is higher and roles and responsibilities are same. In case if my employer has already sent 140 revocation request last week and if i can send AC21 letter with paysubs, EVL etc right away what are the chances here. What would be the worst possible case. Please do post your experiences and ideas.

since you said revoke, your I140 has been approved? If that's the case, you have no problem applying AC21 as long as the next job is in the similar field.

------ How do you say you used AC21?? you have not sent new employer letter+your intent change letter+3 recent paystub copy from new employer with I-485 reciept copy to USCIS. you need to update USCIS to use AC21 ,many wait for RFE then send update. FYI I read many posts of RFE and with RFE they ask many documents and RFE will go to lawyer who filed I-485. what I will do is hire my own lawyer fill up G-28 form and let lawyer send the AC21 letter to USCIS or you can directly mail it.

Thanks Ginnu. I am waiting for your response.
So u suggest its better to send AC21 usage at this time even though i am already working on my EAD to a different company for almost an year and 7 months after 485 RD.

1 your I-140 is approved through employer A
2 your I-485 is pending more than 180 days
3 you are working with B on EAD
if the above is ture I will send AC21 letter from new employer to USCIS so that they have update and with your pending I-485 they attach the AC21 letter by doing this i am invoking AC21
