140 Processing

Hi,

My I-140,485 applied in No-2004 with a substitution labour with a priority date of Aug-1999. Do i have any advantage in I-140 processing since my PD is in Aug-2004.I mean do they process i-140S with older PD s faster?

And for using AC21 from which date the 180 days are counted, from the date of I-140 approval or the date 140,485 applied concurrently?

Its 180 days from when USCIS receives your I-1485 and your I-140 must be approved to use AC21
.

-For I-140 PD is the same date you applied I-140. No advantage is giving for the old subs. LC which in 1999.
- Your I-485 PD is the same date as the Subs. LC filed date which is 1999
- You can use Ac21 after your I-140 approved and more than 180 days passed since you applied for I-485. i.e. (subs. LC date (1999) does not have any impact here).

So for using AC21 180 days from the date I-485 applied(My case I-140,485 APPLIED concurrently) and I-140 approved.

Any clue how NSC is processing I-140s.Mine is applied at NSC.
