140 Motion to reconsider Denied

I received writtern decision for my motion to reconsider.
It says they cannot overcome with their prior decesion.
Denial Reason: In Labor education requirements doesn't match with my educations(Attorney's Mistake)

Guys need help,

I'm in bad shape now, my H1 6 years term is expiring July 2003 so I don't have time to start labor from beginning. If any of your company have approved labor who can file 140 and 485 for me then only I can stay in US beyond 6 years. Please find out with your companies and send me email at mk12350@hotmail.com.

I have 3 years degree + 1 year PGDCA + 9 years IT experience(5 yrs US exp)

Talk to a good lawyer

You should consult a good lawyer asap and then take the next step according to his advise.


How long it took you to get the decision after you file the motion to reconseider.
 
It took exactly 2 months, I don't know what a good lawyer can do in this case.. but I'll try. thanks

im sorry to hear that. did u have any gaps in between ur h1. if so, can u see if all that adds up to 1 yr. u can then quickly file a non-rir and get h1 extension based on the the new law.

also, can u tell me details about ur case:

1. did u file EB2/RIR?
2. what was mention on the labor cert exactly? for eg: BS+5, Major in CS or related...
3. What service center u filed?

I would see if there was any chance of filing an EB-1 or a NIW. In the meantime, you probably should get an LC filed as a backup. You also need to look closely at your H-1 expiration. Feel free to contact me directly.
