140 Cleared but Stamping Issue

I got my Approval Notice for the 8-10th year extension. (I-140 is cleared and 7th year extension is about to expire May 2007). I am going to canada - Ottawa for stamping this march 07.

The problem is my current passport expires Feb 2009, while the approval notice expiry is May 2010.

question is, what will be the expiry date on my visa. will it be Feb 2009 or May 2010. I cant renew my Indian passport now as still have 2 years left and they allow only if it is less than a year.

I am sure a lot of guys would have come across such a scenario. You advise and thoughts are appreciated.

Ur visa expiry date will be till 2010.When u renew ur passport u will get another passport and have old one too.All the visa in the old passport will be valid till the date mentioned in it.So it wont affect ur visa date

I just renewed my H1B visa for 3 years. My visa stamp was issued exactly 3 years as well. My passport expires before the 3 years term. So, when i enter the u.s. via JFK, immigration officer dated my I-94 same as my passport expiry date. he said that once i renew my passport, i can extend the date on my I-94 if i am in here or if i leave the country with new expiry date on my passport, when i return i will be given a new I-94. Bottomline, when u enter, you will get your I-94 expiry date matching your passport expiry date.

you can extend your passport later and then travel to bahamas and come back and get your I-94 extended. i am getting my passport extended now. i will not bother to deal with INS to extend my I-94. it's easier to vacation somewhere and come back and get a new I-94.

I think I-94 will have only upto H1- expiry date. If passport expires before H1.. they give u max of Passport expiry. when u go re-enter they again see if H1 expires before passport. in such a case they give you time till H1 expiry on new passpor..

they dont match passport expiry date.. they match H1-B expiry. You will never get 10 yrs if your H1 expires in 2 yrs :)

I last entered US in Jun05 with a H1 visa valid till Dec 06.At that time my passport was valid till Jun06.I was issued I-94 valid till Dec 06(my visa expiry date) at the airport.So I think I-94 has got more to do with your visa validity than your passport expiry
