Hello Gurus,

Greetings.

Need your expert guidance.

I am currently on H1B with Employer A. H1B is valid till Sep, 2010 (6 years ending)

I also have I-140 approved from same employer. My I-485 is pending.
Job Title on my PERM: Systems Analyst
Salary on my PERM: 70 k
Current salary: 90 K

I have a job offer from another Employer B.
Job Title would be: Technical Lead
Salary would be: 120 K
Job Description: Mostly Similar to what I have on my PERM.

I have couple of questions:
1. Is it possible to transfer my H1B to new employer and get a 3 year extension since I have my I-140 approved? or Will I be get to do only H1 transfer with validity till Sep, 2010?
2. On AC-21 portability to the new employer, will there be any issues with my I-485 approval since there seems to be differences in Salary and Job Title?

Thanks in Advance.

--------------------Yes you can, if lawyer/employer who file H1 asks for it and company submit LCA.

or Will I be get to do only H1 transfer with validity till Sep, 2010?
2. On AC-21 portability to the new employer, will there be any issues with my I-485 approval since there seems to be differences in Salary and Job Title?
---------------- USCIS care more about job duties. if possible try to keep the same title on job offer letter that you send to invoke AC21. Talk to employer that you dont need problems for AC21 or can talk to new company lawyer.

Thanks in Advance.
