What can be a better way to start the morning then today ... my 140 EAC03048xxxxx (concurrent EB2)
MD : Nov 2002
ND : Dec 2002
RFE : Nov 2003
RFE replied : Feb 2004
AD : March 22 2004

approved after a long and frustrating ordeal which basically involved from my side of doing absolutely nothing. Waiting for your fate while you cook up some story in your mind as to why your case is not approved while other with higher ND has,... just consumes your mind and makes it less productive.

I am thankful to all the ppl on this portal whose posts have helped a lot in supporting me daily for advice and comments. Wish you all good luck and I do owe my suggestion posts on this forum and will continue to do so in the future while I starting viewing 485.

Could you please share your RFE experience? How was it addressed? I am expecting an RFE and the suspense is too much to handle.
 
RFE experience

My RFE was about the company's ability to pay and they asked for the W2 form of 2001. My lawyer had somehow forgot to send the copy of my W2. As for company's ability the financial statements of my company from company's accountant was send alongwith bank statements and showing suffiecient to convince that they would have no problem in paying me the said salary in the future ... atleast near future.

Thanks for your reply. It will help in addressing the issue. Did the company also send tax return for previous years....(was there any loss) or just the statements from accountant.

There were losses suffered by company in and after 2001 and the lawyer wrote a letter convincing that the company since then is doing good (which infact it was). I dont know the content as the lawyer is appointed by company but thats the crux of the matter.
