what documents u sent along to prove companys ability to pay?

is your co. in profit ? Was the profit greater than your salary ?

were u working for this co ?

They asked for company's bank statements 6 months prior to application of labor cert.

is your co. in profit ? Was the profit greater than your salary ?

yes co. is doing very good, profit was far greater than salary

were u working for this co ?
yes for 7 months, they asked for copies of the pay stubs

you said your working for them from 7 months and u submited your pay_stubs...
If you don't mind can you share some info....

Is your salary is matching with listed wages in GClabor, or is it different... is so what persentage.......

because, I got similar RFE..... this info will be helpful.

Congrat's SNDMD,

I have my 140 filed with following details still waiting for Approval :

I140:
MD : 6/2/2002
RD : 6/6/2002
RFE : 9/2003
RFE Replied 10/29/2003
Still Pending

EAD - 2nd Renewal 01/13/2004 - Pending
I485 RD : 12/01/2003
I485 - 4/1/2003 Resumed Processing

Is it advisable to Apply for AP...???

Since your EAD is pending, it should be good enough to trigger a look at I140. Jan13 ND should be picked up sometime in April. I am expecting same in my case with Jan7th ND. I hope to get I140 out of the way when EAD is taken up for renewal.


If you need AP apply for it.

Recent education evaluation and Company's ability to pay the salary quoted on the I140 application.


Sent in a new Eavaluation done and my Company's Tax papers for the previous years with my current salary stub and W2 for 2002 .

were u working for this co. in 2002 ? how much was ur salary on w-2 ? Did company tax papers showed profit ?

Can u give number of your lawyer

Hi Atulh,
I think now a days INS is issuing more RFE'on Company's ability to pay, I saw so many RFE's on this... I too got one.... still I need to answer the RFE.... my attorney is working on that....

You said you submited w2 for 2002 along with recent pay stubs.... Is your w2 amount matches with wages listed in labor(GC), if not what % was the difference.... this info is very helpful to all of us who got same RFE....

Yes actually my w2 amount was greater than the amount quoted by $2000+

Two of my cousines are in the same situations as yours. They both got RFE about Ed. evaluation and Company's ability to pay. This RFE reply was received by VSC on 12/3/2003 and 12/9/2003 respectively. As of yet, none of them have gotton approval. It's frustrating to check the status on line everyday and see the same f***ing message.

They both are EB2 and only filed I140. Once approved, they'll do a CP in Mumbai.

Yep that's the way to go if they have a valid H1. In my case my H1 has expired and hence I have to go through the wait. Its more than year now that my I485 has been filed and finger printing done....
