Few minutes back I checked the case status and it says my I140 approved today.
This case has been approved. On November 7, 2003, an approval notice was mailed. If 14 days have passed and you have not received this notice, you may wish to verify or update your address. To update your address, please call the National Customer Service Center at (800) 375-5283.

Category: EB3 [LC was approved during 1st week of January (RIR)]

140 Receipt Date: 01/16/2003
140 Notice Date: 01/16/2003
485 Mail Date: 02/20/2003 (also applied EAD/AP for my wife)
485 Receipt Date: 03/19/2003
485 Notice Date: 04/19/2003
Wife Received EAD: 05/09/2003
Wife Received AP: 05/06/2003
Wife’s Finger Print: 05/27/2003
I am still using my H1B. So far, I didn’t receive my finger print notice.

Just want to share with you all that my 140 was approved yesterday.

ND: Jan 2, 2003
AD: Nov 7, 2003
EB2
No REF
NOT a concurrent filing.

As you all know, this has been a pretty frsutrating process and the worst part is that the service center can't keep a commited date that the application will be processed. From the initially projected 90-180 days to 90-360 then to 90-485 days. Lunkily in my specific case it took around 10 months. Hopeful this is applicable to more cases.

Why do they say it will take 90 to 485 days? Does anyone get I140 approved in just 90 days? Is it possible for EB2 or EB3 cases? How about for people using labor substitution?

Congratulations!

1). What did your I140 Receipt notice say with respect to the projected time it will take them. I am just wondering since your I140 was approved in 10 months. I just got my receipt notice and it says that the projected time is 90 - 485 days!

2). What does the lower value (90) in this range mean anyway??Since no one gets approved after 90 days anyway .. it is more like 9-12 months.

3). Also, is your case a Consular Processing (CP) one? or is it that you filed your I485 later on??

My original receipt stated that it took between 90-180 days to process this kind of application. Then sometime later when I checked the status online at bcis the projected time was changed to 90-365 days. Now as all of us are well aware of it is projected to 90-485days.

As to the lower value of 90 days, I can only guess that perhaps on a day when an officer is smoking something that confuses his thinking, he just approves any file he randomly pulls out. Fortunately for some and unlucky for others, this type of working habit at bcis appears pretty normal these days. We as the clients can only guess, and hope at best.

My case is not a CP. I haven't filed 485 yet. I followed the old way before concurrent filing was introduced.

From this report, It looks like nobody got approved on 1/14/2003. Maybe these people belongs to EB2 Category...
