140 and Consulate Name

Hi,

INS did not indicate which Indian consulate would process my application in 140 approval. Is this some thing we have to specify in P3 ?. OR Do I have to apply for some correction to specify the consulate name?. I belong to the juridiction of Chennai consulate.

It happens some times

Usually, NVC decides which consulate based on the address you provided in your I-140 petition. If you have provided an address falls under chennai jurisdiction then they will assign case number for Chennai consulate. But my advise is that if you have H1B visas from other consulate like Mumbai or delhi they accept Ac140, neverthe less those consulates aer pretty fast and little bit less strict in compare to Chennai consulate. In that case I would suggest you write a letter to NVC with the proof that you come under a particular jurisdiction then they would assign case number to that.

Thanks for the info. If the NVC assigns chennai consulate based on my address, the case will not be considered as AC140. Is that correct?.
 
No..if the P3 and case file transfered to consulate from NVC then it is not AC140

AC140 is you send P3 directly to consulate with 140 approval notice and some other documents (just replacing your physical file with attorney certified documents). In this case consulate directly created a case number for you, this procedure will bypass NVC.
