140/485 Question - Please Help

Hello all,

I have filed for 140/485 in the first week of sept. Based on current processing rate, i guess its going to take a long time for 140 approval. Unfortunately our co. is not doing well. I have a question, please help me.

File 140/485 from company A. Because of layoffs had to join company B on H1 before 6 months & before 140 approval. If company A agrees on not reporting to BCIS about layoff and agree on continuing my 140 & 485, can I at a later stage use my EAD & use AC21 to join another company (after 140 is approved and 485 is > 180 days)? Please help me answer this as my company might agree on continuing 140 & 485 if I am laid off (as a future employee). I hope this is possible as GC is future based.

---- if your company is NOT going to revoke I-140 after approval and hit the I-485 filing more than 180 days and I-140 NOT revoked you can use AC21. if the company is cooperative then request them not to revoke I-140 or enter a DEAL

Please help me answer this as my company might agree on continuing 140 & 485 if I am laid off (as a future employee). I hope this is possible as GC is future based.
---- If the employer agrees to continue GC then good for you. Just find new job in same/similar skills and better join new employer with H1 transfer.
 
Hi Gurus,

My employer said he filed I140,I485, EAD on sept 29, 2003 . It is starnge, the checks which I wrote for EAD in favor of BCIS are still not cleared.

Could anyone explain me, is there a possibility my employer might be lying.

Please help me with suggestions.

----- When did your lawyer/employer send the package to BCIS? Your employer says on September 29, if they sent to BCIS on 29 then your lawyer would have received receipts for I-485,I-140,EAD and AP. Generally the cheeks are cased in 5-10 days, some time bank also takes the time to update the records. BCIS generally sends receipt notices after 10-12 days from receipt of your package. I hope your lawyer sent the package late check with employer or lawyer ask for FedEx receipt

---- Yes many employers lie or lawyers lie. One of my friend case I-140, I-485, EAD AP lawyer sent after 4 months and employer was saying it has been sent. My friend discovered the lie after 5 months when he asked for the receipt notices and found that case was filed very late one can note down from RD on receipts
Please help me with suggestions.
---- Ask your lawyer or employer for the proof that I-140, I-485, EAD, AP has been filed
