Any idea in which category I would be ? EB2 or Eb3 ?
when my H1-B was filled, it was filled as 5+ exp + Bach Degr in Comp Sci..I guess it would be same when it was filled for Labour..

even if a case can be filed under EB2 some lawyers / company play defensive and file under EB3..you really need to ask..as filing a EB2 case under EB3 does not hurt..
filing a EB3 under EB2 is huge risk.. filing a borderline EB2 ( i.e. w/o masters ) under EB2 is also about taking little risk..

sanju...you are in EB3

On your approved 140, if the category is mentioned as skilled worker or professional, then you are in EB3. It doesn't matter what type of degree you hold and the number of years of experience.

The labor advertisement dictates the category, if it had mentioned BS + five years or Master's then it will be EB2.

In my case labor (ad) and approval was in EB3, but while filing I140 it was put under EB2. VSC issued an RFE on I140 and asked us to change the category to EB3. My educational qualification ( 2 Masters, and a PhD) is good enough to go with EB1 or EB2, the labor app is the one which controlled. Now in the deep black hole called EB3 retrogression. :o :o

As of yet, My I-140 is not approved..

If persons fills under Eb2 category... what will description on I-140 Receipt ?
Any idea?

i did mine on 9th and there has been no change in my message...it is the same old 'received on so and so date'

do you know if this changes in a few weeks and typically what happens? does the case really get considered after that or...?
 
485 approval

my wife's and mine got approved yesterday.

nd sep 17 2003
approval feb 17 2005.

had spoken to a vermont person a week back!

if your I140 application says 'Skilled worker or professiona;' then you are filed under EB3. Now just watch out for priority date getting current, nothing you can do now.

I had done case status enquiry in October 2004, and got a standard reply saying that everyone has to go through security check, no man power blah blah nonsense.....
while my repeated enquiry with FBI resulted in response indicating that FBI hadn't received any request from USCIS for name check.

Attaching those FBI e-mails I sent a expedite fax request to VSC in January first week 2005. Again I got back nonsense statements via fax.

I approached congressmen Rush Holt's office for help with the catch-22 situation enacted by USCIS and FBI. They contacted VSC with all my paperwork from USCIS and FBI. This time around VSC gave a response on Feb10th saying that they have asked for name and date of birth check on January 27th 2005. Some one slept on the file for more than a year and caused sufficient pain to us ....hope this EB3 becomes current for me in next couple of months, and USCIS gets it's act together with IBIS and FBI Name check thus paving way for 485 approval.

One false move in US immigration world can cause several months of delay... :mad: :mad:

FBI wouldn't give any information regarding name checks via phone...just tell that they are responding to faxes received the week of oct/nov. You need to send fax to name check department and also send one copy of snail mail. Something will come out of it one day....!!

the letter format and fbi e-mail is there on another thread...

Several discussions spread over many threads on this issue concludes this....
--stopped responding to faxes
--they are responding to e-mails received october 21,2004
--FBI shuts down e-mail fearing security attack


Only option left now is to contact them by snail mail. There is a thread by DashDurai where in the complete mailing address and letter format is given.

the PD spot is left blank on my labor filling date paper. any clue why / how this is possibel? anyone have a similar situation? :confused:
