140 + 485 processing dates past

I have a situation where I am really confused and need help.

My RD date for my 140 was on last week of July 2003 and my 140 is still not approved!!!! They are currently working on October 28th 2004. This is not my only problem, becuase I got fingerprint notices in the mail and went for finger print in first week of October 2004. But my 140 and 485 both remain pending.

My 140 has been pending for 19 months!!!! and my 485 notice date is August 2003 and they are working on October 22nd 2004.

So in conclusion, 140 is 19 months delayed, finger print is done, 485 is 2 months delay. Does anyone know what steps I should be taking to start some kind of a process on either one of these cases? Extremely Frustrated. :mad:
 
we are in the exact same situation....

did you try contacting your senator or did you use any other method?

at this point i am trying to figure out my next steps...senator's query has pretty much been useless and he has been no help as of this stage...
 
This is depressing ..have you done these
1. Senators help on this matter
2. Lawyer can open an inquiry as well
3. Call USCIS and open an inquiry

You have to go after ‘em

I am also going through similar situation, Made 3 inquiry with senator LAST INQUIRY DONE ON 6 FEB 2005, WAS TOLD WAIT FOR COUPLE OF WEEKS.. and one inquiry with congressman IN SEP 2005 LACK OF MAN POWER, one inquiry with AILA in Oct 2004 NO RESPONSE, ALSO WITH uscis NO RESPONSE, ... I don't know wht to do NEXT...

I am thinking of writing a letter to Paul Novak...basically a customer complaint...attaching my letters sent etc.....
I guess this would be one among my last resorts....the next being filing a complaint with the ombudsman...but need to think this thru before asking Paul Novak to intervene...what are your thoughts?
 
yes, i have used a congressman, turned in my letters and all necessary information Feb 4th. Still no response, waiting to hear from him/them.

I am in process of writing a letter to Vermont center to expedite my case if possibel since its past due dates. Two seperate letters one for 140 and one for 485.

and as of the PD date... on my form, the PD SLOT is blank.. any one know where else I will be abel to find the PD date?

I already called the USCIS and they said they will email VERMONT center and i should receive the status within 30 days. My employer called and they said for the employer to wait for 60 days.

we should keep a tab on each other's case/updates.
I have done the exact same things that you did and am sort of keeping a draft of a letter ready to write to the USCIS director.
I am going to send the letter in case if the senator comes back with a shitty response that I do not want to hear...
I too called and they said they'd come back in 30 days, the senator got the same response and the work place got this response in dec and it's already over 45 days since they called...

this is really really terrible and i can tell you our cases are sort of unique...my company applies for a lot of green cards and I can tell you that such a case as mine is unparalled in my company's history..(which has a very good track record) in fact i am sort of hoping that they come back with any adjudication..approval or rejection so that I can damn it move on with my life...

Did you guys got rfe on ur I140 ? I got rfe in May 04 and replied in Jul 04. Since then 4 times LUD change on I-140 but nothing happen..

who is Paul Novak ? how can he helps us ?

My lawyer is not taking any interest in my case... I don't know what to do next ? I am waiting on senator's reply...keep you guys inform once I hear any thing...

I have not received any RFE and the last I heard from VSC was in October 04 via the senator. They told the senator's office that this case would be processed only when the 485 was ready to be processed. It's way beyond ready now and yet no news!

It's funny how quickly they cash our cheques for AP/EAD but take their own sweet time to respond to status checks/expedite requests or any other follow ups and forget giving approvals without a good bit of torture anyways!
 
Thanks dogbert99. I too got same reply as yours from congressman. But now they have removed concurrent process, so they should not have any problem in approving our I-140...I told my senator about this...let see wht happens
Did You guys too mention on ths to your senator ?

LiveAndLetLive - I didn't try with CIS yet. But once I hear any thing negative reply from senator's office . I will try that.

I never got an RFE or anything, but I was wondering what my Priority Date is, becuase it is blank in my papers... anyone know what that means or how I can find out my Priority date is?

anyone here file from MD? I heard that the state you applied from also makes a difference in processing.

when you put in your status request with USCIS, did your case status change to 'we received your request..blah blah'?

it's over a week now and no change on my status...no LUD change either....however I filed the AP/EAD renewal recently and that sucker has been changing every day.

Dogbert99 -Mine status changed with message what you are talking about. See my Signature. Again ,message changed on 7 Jan , stating "Our Last written Notice was undeliver..." My lawyer called USCIS, told thm send it again. But As of yet we did not get it.

I have question, I don't in which category I belong in EB..
When my labour was filled , I had 5+ Yr Exp in SOftware and I am in B.E in Comp Sci. DO I belong to EB3 or EB2.. ON my I-140 it is Skilled Worker and Profesional.. PD Date is Empty.... ON Labour there is nothing stating I belong to EB2 or EB3 ... either there is PD on Labour..

janmanMD - I think u too have same problem.. right..?

you should be under EB-3 category.
one can file under EB-2 with a bachelor's degree and 5 years experience but that is typically not advisable..

you should check you labor priority date and nothing else....ask your company about the labor priority date. That alone is the date you need for any reference in the future.

I asked her once, she told me PD is Date of Labour filling date..is it Correct?
ON my i-140 PD date is empty...

EB-2 and EB-3 can same description "Skilled Workers and Professionals" , provided he has (Master Degree + 3 Yrs exp ) OR ( Bacleror Degree + 5 Exp )

PD first time appears on APPROVED 140..however if you know when labor was filled then that’s going to be your PD.. note that now you have no PD at all even if labor is approved !! that’s the catch..

however while approving 140 if officer sees that your qualify for 485 ( i.e. PD is current and visa # can be allocated ) approval..he/she may approve 485 as well..
