I am happy 2 share this with you that my I-140 and I-485(mine and my wife) were approved an hour ago..!! I was very tensed regarding my wage difference(B/W Labor and my Original Salary) and i was expecting an RFE.

This forum is very useful to share the information.
I learned a lot from this forum...and I will be happy to share any information I know.

I got mails from USCIS at 8 PM and i check it at 9 PM.

I forgot 2 mention that mine is (EB3).

My FP Date is 01/27/04.

Hawa Hawa,
Can you please tell us what RFE u were expecting. Is that ur salary is less than mentioned in the labor if yes then How much (%) and if ur salary is more than what specified in labor then also please let us know the % Difference. Mine is kind of same case, My Salary is 14% less than what is specified in the Labor certification.

My salary mentioned in labor in 80 K.
But my original salary is 60K+(Bonus)
Last year (2003) I got 8K Bonus and in 2002 I got 4K Bonus.
My company is very small with 4 employees right now..

I was expecting an RFE for the employers ability to pay.

Our financials are very good in the sense there are no layoffs and our gross profit looks healthy.

One thing for sure , you dont have to worry if you get less pay than mentioned in labor as long as your companys financials are good (like gross profit and no layoffs).

But still I am kind of worrying.. ours is 70 employee company and very little 4-5 layoffs though we hired over 25 new employee in past 1 and half yrs. Company is doing very well. lets see wht happens.
 
You probably have to worry a lot about it if you applied thru Nebraska service center cause they seem to be very picky. But I don't believe you will have any problem.

Can you let me know your present salary status after your I-140 /I-485 is approved. Are you getting the full salary what it was mentioned in Labor (80K) or do u know if it is mandatory for the employer to give exact or more salary after I-485 gets approved.

i did early FP because my wife FP date was earlier than mine.

NO ISSUES with that. I did it early too and my online message is updated for my FP as well.

First of all i didnt tell my employer that my 140 & 485 is approved.
I am waiting for Approval notices and then i might tell him about it.

right now i am getting the normal salary(@60K).
Actually the company is supposed to give 80K after the approval,but I dont think anyone will check about the salary(as mentioned in labor) after 485 approval.Once the passport is stamped ..its over..!!!

I talked to Attorney @ murthy.She said that according to the law the company has to pay the 80K salary.Usually (very rarely) USCIS checks about the pay.She also said that if i get 60K salary insted of 80K now, it would be a problem if I apply for Citizenship after 5 years.

She also recommended to stay with the company for atleast 6 months to 1 years from now.(as it might be considered as fradulent if i leave now).

I need to talk to employer about this...

Congratulations!! Were there any special documents submitted by your company? My company's size is also similar to your's about 5-6 employees total. I have just filed for I140-485 today.

Your approval gives me little hope that they would not consider a lot number of employees

Thanks for the information Hawa Hawa, well the difference in my salary is now reduced to around 7K. I will talk to my employer lets see what happens. But now this is clear that getting less salary than what it was mentioned in Labour could be problem at the time of applying for Citizenship.
