140/485 and w-2's??

I am in process of filing my 140/485. I havent changed companies. Working for a consulting company. My labor was filed in May2004 2004 i had consistent income. But 2005 and 2006 my income is less.Will it pose any problem in processing of next stages GC. How can this be resolved. Any help?Thanks in advance.

It depends wether USCIS issues an RFE on ability to pay. Are you making the LC wage at this point in time, or does the employer have over 100 employees?

The employer has more than 100 employees. i made the LC wage in 2004 but i am worried about the 2005 and 2006 as i made less money in those 2 yrs.Right now this year there is no problem. The problem also is little troublesome as i am also filing for 140/485 concurrently.Any inputs.

If the employer has over 100 employees then ability to pay should be addressed by this fact alone. You may want to ensure that your I-140 package has a letter from the CFO or HR stating this fact.

Are you making the LC wage now? Why not?

Thanks for your input. I am making the LC wage now?See the problem is i work for a consulting company and i was b/n projects for some time in 2005 and 2006.While i continuously worked in 2004.This year there is no problem.How shud i address this situation with my employer?What questions do i need to ask?Will i have any problem in 140 approval.Any inputs.
