10 days visa validity rule

I was getting ready to go to vancouver for my stamping and then saw this on the appointment letter

"Appointment should be made ten days prior to the validity date on the I-797 or after the validity date has passed.

My 6 year H1 expires on Jan 10, 2007. My appointment is for Oct 2, 2006. Will they give me the new H1 stamp on Oct 2nd? Has anyone been in this situation before? I am going out of country in Dec, and coming back on Jan 1, 2007. Is it Ok to come back on Jan 1, with an H1B stamp that is expiring on Jan 10th, and an approval notice that is valid from Jan 10th?

I too have received the confirmation letter and haven't seen any line as such mentioned by you ""Appointment should be made ten days prior to the validity date on the I-797 or after the validity date has passed".

I too have my apponitment confimed for Vancouver in Nov'2006.

Strange, i don't find any such information on my confirmation letter, pls advise
 
Yes. The 10 day rule applies. I had an experience 3 years ago in Toronto. I got my appointment to extend my H1 for 3 years but at the counter I was told I had come in prior to 10 days before the existing I797 expired. Luckily, I was able to get an appointment the next week. So I extended my stay, got the new Visa stamp and returned to the US

I was confused myself about this rule and hence called the paid #'s of the NVARS website and confirm that while revalidation of H1B it doesn't apply and it does it apply only in case of first time/fresh H1B cases.

Yours was first time H1B or extension?

OR

This rule may have changed in the last 3 years, i believe so!

WHAT more can i think of after confirming with the officer over the phone!
