is that true??

can someone guess how many 140s, CSC may have on their shelves now? if they go at this rate, can we expect some action on ours in coming years??

Well, what I can't understand is _HOW_ the processing dates are advancing forward. I've been watching the dates closely for what seems like forever. Over the last several weeks, the dates have moved forward pretty fast.

The last update for example.... On April 22 the date moved from May 28 to July 16... thats 18 days in 14 days.

So... if they are only processing roughly 10 applications a month, HOW THE HELL is the processing date moving forward like that?

What a load of complete bullshit. I am so goddam fed up. I just want to scream or go postal. FUCK!

Hi Guys,

From immigrationwatch.com i have seen lot of 140 approvals(around 333)in vermont.But in Ca only 10.What is this??

CSC processing

there is one post in labor sub forum under CSC. someone's EB2 140 (labor sub) is pending for 21months without any RFE!!!!!! that is sooooooooo horrible.

are these moving dates to fool someone into believing that they are doing some work? hope it doesn't turn out like 2 yrs for 140 and another 2 years for 485. :-(

Mine is pending for more than 2 years

Yes, to be precise my I-140 is pending for more than 775 days now.
RD - March 2002.
1st RFE - July 2002.
2nd RFE - April 2003.
RFE responded - May 2003.

EAD/ AP approved April 2004 after 1 year 3 months.
Just wanted to share with you guys.
Thanks.

I seriously doubt the correctness or currentness of immigrationwatch.com statistics. On the same page where they say 10 I140s were approved, they also say that only 12 I485s were approved in CSC. If you check the I485 thread, you will see that the number is much much more than what they are saying.

I wonder if they have kept up with their regular scanning. If not, it probably is not a good indication of what is happening in reality.

140 processing rate

immigrationwatch.com says there are 12000 odd I-140s received in 2003. even if they are like 8000 or so, it will 8 months if they process 1000 140s per month!!

1000 in a month??? we can only dream about it.

hey, guys,

check the updated processing times for CSC:
EB2: no progress
EB3: only 1 day difference

WOW...what is this???

I am very disappointed to see this type of progress....

I-140

hi everyone, i'm new here in this forum.
i hope you can help me clear my queries.
i would like to know why certain I-140's gets approved first later than your priority date than yours? is there any basis for the USCIS to this? 'cause i'm wondering some gets approved by 2 months and some for years?
and how true that if we call USCIS to verify the status that's the only time that they'll be opening your case?are they waiting for the person who filed it?like in my case my employer's lawyer filed it and they're telling that they're expecting my approval this october. how can they project such time?and why not earlier?
can i call USCIS and check what's happening with my application?
by the way i'm from the philippines and my receipt notice is WAC0408 received by USCIS february 5, 2004.
one thing more, what about those RFE's and FP? i haven't done any of those... :(

hi darvin0715,
RFE --request for evidence. usually BCIS request for more information, that's called RFE ( like requesting latest employment letter, latest pay-stubs,W2 ..etc)

FP -- finger prints, This applies to 485 cases. If you have filed 485, you may receive finger printing notice from BCIS.

I-140 concern

thanks desi145,
would you think it's possible for me to ask USCIS about what's happening with my application for I-140?
why do others get approved first?

hard to expect anything from CSC unless we can sue them

Here is the sad news from http://www.immigration-law.com/

05/14/2004: California Service Center Concurrent Adjudication Pilot Initiation and Warning Against Abuse

We reported earlier that the California Service Center was launching I-140/I-485 concurrent adjudication pilot program for the concurrent I-140/I-485 filing cases inasmuch as it is non-National Interest Waiver case and filed after certain date. Qualified cases were supposed to be adjudicated in less than 90 days.
Apparently, CSC is concerned at this time that those who have already filed concurrent I-140/I-485 cases or I-140 petition alone may withdraw the pending cases to refile a concurrent I-140/I-485 case to take advantage of the pilot program.
AILA reports that CSC will not take such withdrawn-refiling cases qualified for the pilot program and will not adjudicate such cases concurrently. It appears, though, that such decision may raise a legal question of arbitraniness in administration of adjudication function. It may also raise the issue of "equal" protection and fairness. The agency may create a "class" without permissible legal justification or constitutional basis just as seen in the "Francis" decision. We'll see.

darwin

Hi Darwin,
I am not sure whether BCIS operator can tell you anything, since your date is Feb 2004. There are very few exceptional cases getting approved out of order..but in reality, They are currently processing I140 for 7/2003. Even I am waiting since 8/8/2003...no news..so just hold tight and enjoy the ride..

Perhaps we dont need to sleep to see this dream.

1000 a month can be processed - 10 approvals and 990 denials!

In this case, it sounds CSC is a little bit "anti-immigration" with an "almost-screw-you-all" attitude...:)
