Re.
I don't know if you have an interview scheduled or not.
If an interview is not scheduled, INS will send you letter
to justify it why it should not denied, meaning you prove
them wrong on the issues that they comntemplating to
deny your case. You get a chance to give your version
just like in courts.
Even after your reply, if they are not convinced they
could deny your case. Now, you have options like
changing back to other Visa statuses. Yes, legally
your status on the day you receivve your denial notice.
Both EAD and AP too. However, practically now INS will
try to find to start Deportation proceeding if you don't
have valid status by now. How soon they approah you
is not clear now. But, you also have a another chance
to appeal your case with Immigration Courts and your
status will be reinstated during the Court trial.
Post 9/11, things have changed. There has been some
discussion, you only get one trial to prove your case and
your rights are now somewhat limited than before
9/11.
But, if you are going for an interview and they deny you
they will tell you all what to do next. Ok. So, don't
worry. Here also, your status goes illegal and you have some
days, grace period to either to change to other status or
leave voluntarily US. Or approach Imm. court for
appeal. ANd then, it works same as above.
Hope it helps you now.
Why do youy think your case will denied.
I think about 98% cases are approved unless some
serious violation or felony etc cases.
