I-485 Rfe

Hi Guys,

Can someone tell me how long it takes on average to hear back from USCIS after responding to an RFE? Here is my situation. My attorney received RFE on 12/17/2004. We responded 1/11/2005. According to USCIS the responses were received on 1/12 for my daughter and 1/14 for myself, my wife and another daughter. The LUD changed on the following dates. 1/12,1/13,1/14 and 1/17 for my daughter and for the rest of us it changed on the following dates. 1/14,1/17,1/19,1/20. Since then the LUD had not changed for any one of us.

Also, in response to the RFE's, we had to pay a penalty of $1000 each for filing I-485 supplement A form, except for my daughter whose LUD is 1/17. This is because she is under 17 years old. Even though the checks were received with our responses, they have still not gone through my bank account yet. I don't know on average how long it takes the USCIS to deposit checks. Maybe someone would shed some light on that for me.

Concurrent I-140 & I-485 filing. RD - 11/07/03
I-140 AD 6/22/2004
I-485 RFE ND - 12/17/2004
I-485 RFE Response RD 1/12/2005

Anxiously waiting.

What was the RFE about? Why did you have to pay the $1000 for each applicant?

The RFE was about us having been out of status at some point. We fell under the 245 (i) law. The penalty for that is to complete the I-485 Supplement A form and pay a fine of $1000.

In addition to that, my RFE also requires me to show that I will not be a public charge.

Even though I filed my GC as a future employee, I started working for the "future employer" after EAD was issued .
The RFE for I-140 was mainly oriented towards the company's financial ability.
But the law firm insisted that I furnish my pay stubs.
Does that answer your question?
