I’m asking on behalf of my friend and would appreciate any guidance.
She has been married to a U.S. citizen for three years. They married without a prenup and have two children. Their marriage-based green card interview was recently scheduled for next month.
Unfortunately, her husband has been threatening not to attend the green card interview unless she signs a postnuptial agreement. The proposed postnuptial agreement is heavily one-sided and only favors him. When she refused to sign it, he said he would not show up for the interview.
Prior to this situation, she has experienced episodes of emotional/mental abuse from her husband.
She is looking for advice on what her options are, both regarding the green card process and her safety/legal rights.
