Yeah. Possibly. I hope I get something by snail mail soon, so that I can at least confirm what has happened :-) Otherwise, I am just speculating on what might and might not be. What's the USCIS stand on revocations in case they made a mistake ? There was some recent law that was passed to allow...
FWIW, my I-140 receipt notice does say "Skilled Worker or Professional". So, that does mean that its an EB3 case. I dont have my approval notice yet. Will wait and see.
Hmmm. I will check the section on my I-140 tonight. The chances are rather low of it being EB2 because my ETA-750A(of which I have a copy) has BS + 2 years as experience and when I had initially provided my experience letters, my lawyer had asked for a total of only 3-4 years of experience. I...
No. The only LUD that I had without message change on my 485 was on 04/14. All the other LUD's caused some change in the status(mostly related to fingerprinting) The only LUD on my I-140 after the initial receipt was for approval. The LUD was on 05/13 without any message change and on 05/16, the...
I have posted in the 485-CSC forum too, but just fyi, it seems like my I-485 has been approved as of yesterday(05/23). The reason I am circumspect about this is because of my PD(EB3-Nov 2003-INDIA). Will keep you posted as the mystery unravels.
Thanks. Yeah, it is a tad unfair that you havent got your approval. Hang in there though is all I can say ;-) USCIS sure acts in mysterious ways, so I wont even attempt to analyze its behaviour. Anyway, will await the paper before opening up the bubbly.
Hello all,
I have the following status on both mine and my spouse' I-485.
This case has been approved. On May 23, 2005, an approval notice was
mailed. If 14 days have passed and you have not received this notice, you
may wish to verify or update your address. To update your address...
No. The I-485 processing will continue. The only effect might be of sending in AC21 proactively instead of getting an RFE for EVL. This is just conjecture though based on the fact that USCIS might have applications indexed by name. Someone else might know if that is the case.
My $0.02
For the original poster, revoking the underlying I-140 will not have any implications because the I-485 has been pending for over 180 days. The new AC21 memo that has come out is very explicit in what is and is not possible with different I-140/I-485 combinations. Given all of this, it...
LUD on my 140 - Friday the 13th :-)

Not to divert attention from the OP's question, but is AC21 still valid if the approved I-140 is revoked ie if someone used AC21 because I140 was approved and were six months past I485 filing, would the I140 revokation cause a denial on the I485 ?
Ac21
AFAIK, you can transfer your H1 and invoke AC21. You still would not need an EAD for that. Remember that a green card is for a future job and invoking AC21 will only indicate that your future employer will be different.
Of course, from what I have heard, these days employers would much...
I had an LUD too 04/14/2005
On my I-485. Nothing on I-140. Must have dusted something off the application :-)
PD - Nov 2003
I-140/I-485 ND - 12/16/2004
Hello,
Here's the scenario :
My current LC is filed and approved for a Programmer Analyst position with the associated job description. I have filed for I140/485 concurrently and am affected by the retrogression of dates. If I use AC21 for a job that has a similar job description and later...
