Understandable. I guess the different fates for cases transferred from CA to Dallas and Philly can be the basis for a law suit. But, I doubt what you can gain from it.
For EB2 filed under PERM and approved before end of Sept, I485 can be filed before then even though they probably have to wait for a long time for approval, but AP and EAD can be filed too for those cases.
I don't believe it works that way. Unless their I-485s have been approved, they have to wait in line according to priority date. If your priority date is earlier than theirs, even though you file next year (hopefully), your case will still go before theirs.
