You can interfile the EB1 I-140 to the existing EB2 485. No need to file fresh 485 at all. This replaces your EB2 I-140 with your spouse's Eb1- I140. It is doable. One of my firend did it though replaced EB3 with EB2, and got it approved. All the best.

You can hang on until H1 expires No matter what's the outcome of the I-140(even the worst case scenario --denial of 140 or 485), you can still hang on until your H1 expires (Dec 2007). This is the reason it is better to maintain H1 status, even after one has got EAD. Good luck with your RFE...
