St4rGuitar,
Pardon me for not mentioning that he is completing his part-time accredited Masters from a State University here in US and is about to apply his EB2 I-140 based on Bachelors+5 years progressive experience criteria (as mentioned in the LC). At the time of applying his I-140 he...
Question for st4rguitar
st4rguitar - Thanks for providing such valuable advice to all the forum members. Here is the situation for facing one of my friends:
Backlog LC was approved sometime back and he is ready to file I-140 in EB2 (MS+1 or Bachelors+5 years progressive experience). He has a...
Yes this degree was accepted for admission to an accredited MS program at a State University here in US. The program director of the department offering the course has even provided a letter stating that they have accepted the 4 year foreign bachelors for admission to the Masters program. This...
Have you seen any RFE when distance education degrees not recognized by UGC in India. For example a foreign Bachelors degree obtained in India which is not recognized in by UGC but recognized in the foreign country.
I don't think this is true. There is no criteria anywhere which suggests any degrees or diplomas from India should be accredited or recognized by the UGC. There has not been a single instance of any member on this forum whose I-140 was denied because their degree or diploma was not recognized by...
Who says Diplomas should be recognized by the UGC in India. A lot of private institutes in India offer computer diplomas but very few are UGC approved. There has hardly been any post by any member on this website which says their I-140 was denied because their degree or diploma was...
I have a 4 year degree from India which has been evaluated to US Bachelors equivalent followed by 5 years of progressive experience prior to joining my current company.
My approved LC has the following education requirements:
Masters degree or Bachelors+ 5 years progressive in the job...

I don't think its worth-while to file another PERM LC especially since PBEC has recently approved some Dec 2004 cases which indicates it may soon start approving cases in 2005. My guess is that an LC with PD of 2005 should be approved around the April or May 2007 time-frame. However PBEC has...
Maryland EB2
My details are below. I do believe those LCs with PD of March 2005 would take longer to approve due to the large volume of LCs which were filed during that period just before the Mar 288 2005 PERM deadline.
I don't expect my LC to be approved anywhere before May or June 2007...
Well its not surprising that USCIS recently raised the fees for Appeals. The likely reason maybe the increase in number of appeals being filed and less resources to handle the filed appeals/cases. Even if EB2 AAO appeals take 3 months as suggested by your attorney, you should still plan ahead...
The best course of action for you would be to file a new PERM LC application which is carefully tailored to your educational background and skills and falls in the EB3 category. For example the PERM can be worded to include "suitable combination of education, training and experience". AAO...
I would not jump to the conclusion that approved I-140 applications based on 3 year degrees evaluated as 4 year US Bachelors equivalent cannot be revoked at the I-485 stage. There is always a certain element of risk involved in such evaluations and until USCIS provides clear direction on this...
Congrats on the I-140 approval. I am sure you must be very happy. However please note that you need to be aware of cases wherein USCIS has revoked previously approved I-140 cases saying these had been "approved in error". Please ensure you have proper backup plans in place to take corrective...
Should be able to file in EB3
Based on the experiences of other members in this forum you should be able to file in EB3 using the same EB2 labor. Try filing I-140 using premium using the same EB2 LC. Please see the below forum for information on how other members on this forum were...
