    Consequances of using AP

if you get AP, do you HAVE to use it? hi all, I'm reading the thread, maybe someone knows the answer to my question. I just got 140 approved, and my attorney is going to file 485/765. He asks me if I want to do AP too. I still have 7 months on my H1B. If I do apply for AP, do I "have" to...

    PERM Tracker - Chicago

hi my PERM was filed on the 17th ... everybody, please go to http://www.trackitt.com/usa-immigration-trackers/chicago-perm-tracker/ and enter/update your case there. According to the trend shown there, the approvals are averaging 15 days or so. I'm 'sickntired' on that site.

approved ! Guys, I always thought this would be my happiest day ever, but it's sooo freakin' bittersweet ... just 3 days after I left my employer, got email from laywer, my labor has been approved. Talk about timing ... it's just insane. Bottomline is, I just lost an approved labor with PD...

Tot, I "thought" my old labor was EB3, but in fact it was EB2 all the time, I just didn't know about it. If you're really qualified for EB2, you should go for it. I don't understand why your lawyer said "not to transfer" ... it would NOT be a labor transfer, you'd be filing a brand new case...

EB3 or EB2 hi guys, quick update ... I found a new job, and they'll file PERM for me. the bad news is that I just looked at a copy of my labor application ... the job description says BS with 5 years, which puts me in the EB2 category ! I'd always thought it was EB3. If I had known this...

sorry, I think he needs to see a lawyer ... if he has just gotten his labor approved, then his labor is NOT pending anymore, and he has not filed the 140. He's in right in the middle ! He needs to file 140 asap and only AFTER it gets approved he can use it for H1B extension ... just my...

H1B transfer + extension hi guys, sorry for posting off-topic, but I need some help ! my situation is kinda weird in terms of the expiration dates, so I wonder if anyone has comments: - I'm employed with company A, and my current approval will expire on Nov/10. I still have one extension...

If I were you, I wouldn't wait, just ask your HR (easier than lawyer) to write a letter to PBEC. It's a very simple letter, mentioning your case id, name, etc, saying that the employer wants to pursue the case. Even if after that you do receive the 45-day letter, you send it again. Remember...

hi Nyprog, from your case id, your letter has already been generated, but don't wait too long, because if there's a mishap with the letter, your case could be closed ... have your HR write a letter to PBEC confirming your case is valid, so you won't get it closed wrongfully. It's worth doing.

NeverGreen, if your case number is P and you haven't received the letter, I'd strongly suggest you have your HR write a letter to PBEC to tell them the employer still wants to pursue your certification. Otherwise your case will be closed due to lack of 45-day response. It has happened to several...

Hi Magra, just be careful with your "theoretical" job ... the whole idea of EB green card is that you HAVE to work for the company that's sponsoring you after the adjustment, or it could be considered a fraud and your gc could be cancelled ... I've read that typically you have to work for 6...

You need to email them (check previous 200 pages to find out the email address :) ), asking for proof for 7th year extension filing; they'll email you a screenshot; if the case number starts with "P", then the letter has been generated; Once again, the problem with GreyNichols' closed case...

Akela, I think that chances of denial after clearing state are VERY low, I don't remember ever seeing a case where someone got a NOF or RFE after clearing state. I may be wrong though, so someone may throw in their 2 cents too. Don't worry about it, the reason you haven't been approved yet is...

that's basically a canned response they have, I've received similar letters too. At least they try to respond to the letters, which is a good thing ... the guy (Beverly) is a nice guy, I've talked to him on the phone, he's aware of the whole bruhaha, but I think they can't do much because it's...

yes, I'm trying to do the same, if I find a new sponsor, I'm gonna transfer my H, then file PERM and then depennding on the timing, I can extend my H based on the old pending labor. I don't think there's a way your company A can try to stop the transfer, there's nothing they can do about it.

Yes, you can file PERM with a new company, because EB greencard is for future employment. However, you can't extend your visa based on PERM ... after you have an approved PERM, then you can file 140 and then, AFTER 140 gets approved, only then you can extend your H for 3 years. I don't think...

you'll only get your EAD after you get PERM approved, then 140 approved, then file 485 ... total time here is probably 8 to 12 months, is your new employer gonna wait all that ? that's a sweet deal :) in that scenario, then in the mean time you'll be extending your H1B based on your on-going...

that's exactly my point ... this provision does NOT cross our road, it will be a completely new category, meaning we will still be here trying to get a meaningless piece of paper from the DOL, because we belong to another category (EB). Actually, maybe we should lobby for them to add H1B...
