Just got the emails from USCIS. My long wait is over.
I have been a member of this forum for almost a year and I have learned a lot in the process. It has certainly eased the pain. THANKS A BUNCH!

VSC "rep" is actually USCIS Officer
When I called VSC last week, the lady on the other side of the phone identified herself as Officer XXXXX.
However, she would not give me any information on my case, as they are there only to solve major problems and my case is pending for 12 months only :))
As far as I know, there is no way to electronically track your case at NYC. It takes a while for an interview (someone I know waited for almost two years), so after six months I would suggest you take an appointment with Infopass and check with them live.
Being able to talk to an officer...
Lawyer response
Here is the response my lawyer gave today on this issue:
"There would be no benefit at this time to asking your wife to petition for the I-130 as you would need to withdraw the I-485 currently pending and re-file another. Moreover the I-130 petitions of this type are not...
No need to convert
Once a Green Card holder, there is no need to officially convert to family-based. After three years, you can apply for citizenship on the basis of marriage by showing the marriage certificate.
Similar Situation
s_u_r,
I am in similar situation, only my RD is 1/14/04 :(
My lawyers (large, reputable firm) told me that one cannot have two I-485 applications outstanding at the same time. If you file family-based I-485, it will take a long time.
In your situation, I would use...
Concurrent Processing
Seems to me that EB2 I-140s have been left behind to be processed concurrently with I-485s. Thus, the timing of I-485 will govern. The latter just advanced by 3 months to November 2002.
Bye, bye AC21
I was wondering if there is any relation between H-1B and I-140 processing at VSC, in that the same team of people might be reviewing both.
For people who were checking this forum back in April, we saw an acceleration in I-140 processing as soon as the 2004 H-1B quota was exhausted at that...
I-140 hindered by H1 processing?
All I can think of as the reason for the delay is that the H1 cases for fiscal year 2005 are being worked on right now. Maybe that has delayed EB I-140 processing. Remember that the latter sped up back in March when they finished processing H1s for fiscal year...
