My own opinion: It makes no difference to apply by yourself or via a lawyer. The key is that you have all the required documents (company's reference letter, no criminal record, etc.) If you are now in the states, it is usually easier and quicker.

Just one more question, what do you mean by "valid and current visa"? The only visa on my passport to USA is H4 visa, which was expired in 2001. Is this a "valid" visa? My H1 status is valid and the latest I-94 is not expired.
