I got opposite idea from reading the Cronin Memo. The second paragragh under question 5 tells you that the nonimmigration status (H1-b) will not be remained.
Question 4 and 5 talk about 2 different situation - whether you have a valid AP but reenter by H1 or you reenter using AP.
Did you renew it online or by paper? Which service center you belong to? I applied it on Jan.6 and have not got it and my current one will be expired on Apr.15.

Hi, our 140 has been pending for more than 1 and half year. Since we have to be out of US for a month, is it OK to use our AP to reentry? Is there a risk that 140 will be denied during that month, the airport officer can detect it and refuse us to enter US again?
