    Filing I-485 in home country?

No Can Do I-485 is "Adjustment of Status", meaning you must be in the US to file. 9/11 didn\'t change things at all in this regards. You must have been in the US to file.

Jim Mills - Your expert opinion is needed

Yes, but Look - if you didn\'t have a job at the time of the Green Card it will come back to haunt you, either now or later. You might as well take the $1000/month or whatever it is and help yourself out. Just my thoughts.

Jim Mills - Your expert opinion is needed

Partially Incorrect 1) There is no requirement that you be employed at any time during the I-485 process. However, you must be employed in a similar occupation when it is approved, so you should find another job ASAP. 2) So long as you are eligible to work in a job (EAD) and in the country...

Strange Problem - Want to go to India

Don\'t do it If you have no job when your I-485 is ajudicated, you have no Green Card. If you get an RFE for employment letter, how will you respond? If you get an approval without RFE, what will you do when at the naturalisation interview or 10-year GC renewal they ask you about how long you...

    Drivers License

Not necessarily MGM, keep in mind that EADs are given out to folks that have filed an I-485, but there are other reasons for them being filed. Non-immigrants in E-2, J-2, K-1 and L-2 status can also apply for an EAD. An individual whose status has expired (let\'s say the L-1 holder is laid off)...

    Drivers License

EAD does NOT prove Legal Status The EAD does nothing of the sort. It just means that you can work. The I-485 receipt proves legal status; you can file I-485 without an EAD and be legally within the US.

Just spoke with a courteous IIO at VSC

It\'s basic numbers I think in July 2001 was when the priority dates became current, so there was a larger than expected volume of I-485 cases that month.

Need Help... Domestic Air travel on EAD/H1....

EAD is USELESS An EAD is 100% useless for proving legal status within the US. That\'s why the cards themselves state that they are not good for re-entry into the US. If you want proof of status, carry your I-94. If it has expired, carry your I-485 receipt. The EAD does nothing - it is perfectly...

Do U Have To Apply For Ead

EAD not required for spousal EAD It is perfectly permissible for the spouse to apply for an EAD, irrespective of what the H1 holder does.

RFE response received by VSC, but heard a terrible AVM message

Don\'t worry You should get a response (usually approval) within 30-45 days.

Please give me u\'r thoughts / any one used it? Can I use AP for travel while on H1 or do I need to

No need to revalidate If you have AP you no longer require your H-1B. Keep in mind that if you have non-citizen dependents your re-entry on AP requires them to have a filed I-485 to maintain valid status, and they will require AP to re-enter the country. You will also need an EAD to continue...

    After 485 approval...

Shouldn\'t be There\'s no requirement to get your passport stamped. Although you probably would want evidence of your new status in the US, since your old papers are now null and void.

    Calling all 245i people.

Don\'t Forget 245k As the beneficiary of an EB Green Card you could claim relief under 245k and save yourself the $1000, provided you were out of status for less than 180 days. You might be close. Don\'t let your lawyer and the INS deprive you of the $1000 penalty without checking 245k.

    Calling all 245i people.

Nothing special If INS doesn\'t raise an RFE you should be OK. If they claim that you were not in valid status, then you just claim relief under 245k, so long as less than 180 days have elapsed between the expiry of the I-94 and the receipt date of the I-485. There is no penalty for a 245k...

After 180 days of filing for 485

Only One Thing Matters The only important thing is that you be employed at the time of ajudication. If you take a few weeks off that\'s OK if you\'re still a ways away from being approved.

    Immitracker never updates

Another Tracker For what it\'s worth, there is another tracker I maintain at http://instrack.sce.net/. It was mainly geared towards VSC I-140 processing times, but it\'s starting to get enough I-485 times to become representative. The other advantage is that I haven\'t updated it since July...

    Good/Bad FP News

Some Info I am in Atlanta, GA. My LC was for VA and other \'unanticipated locations\', since our head office was there. I was laid off in March, before I-140 approval, but the company at the time indicated they would have some work for me in the future, and provided an employment letter in...

    Good/Bad FP News

Thanks for your feedback Based on what we\'ve seen, do I need to be worried about getting approved before 2/25? Ordinarily, I\'d say no, but this fingerprint notice has caught me completely off guard. I didn\'t expect it for another 4-6 weeks.

    Good/Bad FP News

Lawyer sent me an e-mail today saying that I have an FP interview on 12/20/2001. My RD is 8/28, ND is 10/26. I am intending to use AC21 so I would have felt better waiting until Jan/Feb. My \'magic date\' is 02/25. First, isn\'t this an unusually short wait for an FP notice? Is there anyone...
