My previous company sponsored my I140. So I am assuming I am EB1?
My case detail:
I140 approved in July, 2002
I485 filed in Sept, 2002 and now passed 180 days.
EAD and AP available, expire in Oct, 2003.
Thanks ginnu.
Further questions here:
How can I provide proof for the "same field"? I don't have LC, so what kind of document can I ask the previous employer for reference?
Thanks Chicago4U! That's what I call real help!
Actually right now my only concern is whether AC21 can apply to L1 visa holders because I was holding a L1 visa and now it's expired and I am depending on I485 now.
AC21 seems only to apply to H1-B visa holders. Can I use it to change...
jaxen, you are not helping at all. I've read many threads in this and other forums and it's you that confused me - everybody was discussing whether it is legal to work for another employer after being laid off while I485 is pending. You said it's ok to work for ANY company.
I wasn't worrying...
Are you sure? If that's the case, why there are so many people in this forum discussing about AC21, switching employers after being laid off, etc.?
Could you please point me to the rules?
Thanks for the advice, jaxen!
Questions:
1) Does AC21 only apply to H-1B visa holders? I am a L1 visa holder. Can I use AC21 as well?
2) AC21 doesn't address the question whether or not the spouse can work while the main applicant is searching/working for a second company? Any ideas?
Hello,
If I am laid off and plan to use AC21 to find a new employer while my I485 is pending, will my wife be able to work for any company?
She is also I485 pending and studying at a university right now. The school asks the students to find intern jobs during summer vacation. (Note that...
I read some threads on other forums regarding the length of time that you must work for the same company AFTER you get the GC. They say as a rule of thumb, it's six months.
The question is after I485 is approved and you get the GC, what documents/proof do you have to submit to INS to prove...
Thanks sankarnp! That really helps.
So seems like your new company informed INS with those paperwork they prepared for you 13 months after you filed I485, right? Then I'd guess by that time, your GC was most likely approved already before INS got the notice from your company.
If this...
Thanks Ray.
But I guess my question is how do the Canadian government know your absence status except you tell them in the PR application form? What will they check to see if you are telling the truth or not? What evidence do they check?
Thanks!
Thanks Ray.

So if I change employer, should I inform INS proactively or not?
It seems that if I inform INS, it's like asking them for RFE.
But if not inform INS, it will be considered cheating and denied at the final interview, if any?
Thanks for the reply, bumblebee.
My previous company's lawyer will find out anyway because they will renew my AP and EAD soon. So I am thinking if I should tell them then and ask them if they are willing to help me (I can pay them of course) or if they think there's a conflict of interest, I...
Hi all,
I landed last Feb and now need to drive to Canada to apply for PR card, but I need to return to US immediately as my I485 is pending.
Here are the questions:
1. What do I need to bring there in order to return to US? I have advanced parole document and AOS notice. Are those...
