Coke, Since she was sponsored for her adj of status prior to the expiry of her B2 I94, she was never out of status. And yes, she will've to surrender her B2 I94 when leaving the US. When returning to the US, she should make sure that she enters on AP (not B2). She will be given another I94...

MV, No the FP took19 mos. At that time, the duration for 485 approval was 20 mos. If the 485 clearance is within 15 mos now, then you guys should've your FP within 12 mos of applying.

Flamingo, That is not a problem at all....you can travel on the I551 (temporary GC) & you'll've GC status. That stamp is evidence that u r approved & are waiting to receive the plastic GC card.

Cokecola, You can call up the BCIS 800# & ask them the normal time frame for obtaining AP at the Dallas District Office. If you have waited more than their stipulated time, ask them to inquire w/Dallas office on your behalf......may work.

MV, this is news to me....my parents did not have to undergo such finger-printing at the Dallas office for AP approval. They received it in the mail. Are u sure it is not GC related FP?

I don't know much about the rules for sponsorship by GC holders, but I believe she will need a valid visa to continue living in the US after the 130 is filed. If the 130 is filed overseas, I don't think she can revisit the US until the 130 is approved (unless she has a valid visa).......again...

Yes, there is a major difference. 1) If a 130 is filed outside the US, your wife will not be able to travel to the US until the 130 is approved (takes usually 9-12 mos). She would get her GC after the 130 approval. 2) If you file the 130 for her in the US, she can't continue to stay here...

Chenya: Once the I130 is approved via consular processing, you do not have to file your I485. The I130 and 485 should be filed together if the GC process is initiated in the U.S, i.e. the person to be sponsored has arrived in the U.S (on a B1/B2, F1, H1 visa, etc). Otherwise, only the 130...

lPrasad, as Detroitmii said, usually it does not take long to get the I130 approved when undergoing consular processing (about 9-12 mos). However, the drawback of consular processing is that your parents will not be able to visit US until the consular processing is done.

Give more details....did u file just the 130 or 130/485 concurrently? Also, did they use the B1 visa to enter the US after the above applications were filed?

Cokecola, your wife should be close to getting her AP now. I don't think the delay in mailing the 693 medical report should have any impact on the processing of the AP. The 693 is for the processing of I485, not for the AP.

No Zeeshan...you cannot check the status of cases filed at local INS offices. That number on the receipt is pretty much useless to you, but you should keep the receipt as proof of filing the application. When you receive the approved AP, you will get the A#. Most I485/130 applications filed...

Itoo....it is not necessary at the outset to submit the I-693 (medical report). If you don't submit it now, the INS will request it during the final stage of the process, i.e. at the interview stage. It is better to do it at that time because the medical report has a 12 mo. validity. Usually...
