    Don\'t do medical just yet It does take only couple of days to complete medical (expires in 6 months). Better make sure that you have proper birth certificate , marriage certificate etc.

    My EB3 took 15 months Applied Jan 2001, RFE for original labor cert. replied in June 2001. I thought that the file was lost or something but finally got approved last week. don\'t trust these unofficial dates.

    Let me tell you whats strange WAC-01-104... received an stupid RFE for Labor Cert (which they already had), copy sent in June , received in July, no response yet. Everytime we ask they say "Officer is working on it".

    Clarification needed on I-140

    Yes They can outrightly deny the petition without sending an RFE if they are conviced that even a perfect reply to RFE will not change material facts about the case. But, usually, they send RFE before making any decision.

    Unfortunately, its a denial I don\'t know the details of your case but if it was EB2 BS+5 or something, you can ask your lawyer to call INS and ask them if they can approve it in EB3 (the chances are that they will say no but nothing to lose).
