I finally received my FOIA records (please see signature for background).
Should I go ahead and file for AOS using the CBP records or should I attempt to request for replacement of I-94 first?
Are the FOIA records sufficient enough to prove my legal entry. (It states my admission number, date...
I think if you post your timeline..i.e. date of entry, type of visa, POE, info about DV lottery it would make things a lil easier and get a better response.
File for FOIA, I am in the same boat (passport stolen along with I-94). I filed for my request in April (for both FOIA and Visa records), just called y'day to check on the status of my request and they are still processing the April requests (it takes approx 6-8 months to get the info now)...
Yes will be my first interview. My husband is older.
My passport and I 94 were stolen a year after I came here and then I heard a lot of different stories from people that caused me to 'fear'.
And one attorney told me that I would never be able to get my I-94 records and that I will have to...
I have a question,
does the age difference matter when you get interviewed for AOS? My husband and I are 7 years apart and we married out of love, and plus he looks way way way younger than his age.
Thanks
just a suggestion may be the post should be something like this
US Entry date:1997
US Entry Visa:b1/b2
Marriage Date: 2002
AOS Applied: (date)
AOS Approved: (date)
that way we can see if you filed right away, what kind of visa and how long it took to get approved :).
I agree hopefully it would. People usually just come back and say they have been approved. Sometimes they may or may not post their experiences but is always in different threads or just creating their own. So I hope it becomes a sticky too! :)
A copy of his stamped passport and or I-94 or even a boarding pass should be sufficient. Otherwise I would advice you to FOIA your records. A lot of times when you apply for I-102 the request gets denied because you must send your app with supporting docs like police report and or affidavits...
I think the idea of putting your application on hold is good one while you get your other POE doc's together.
Was your I-130 approved?
Did you have the AOS interview or they just returned the application?
Another way to prove legal entry is to FOIA your I-94 records. (Do you know your exact entry date and POE?) I am somewhat in the same boat as you, but I decided to FOIA my records first before applying for AOS. I requested my records in early April and just called them on Friday to get the...
No I haven't started the process yet.
I FOIA'd my I-94 and visa records with the state as
my passport and I-94 got stolen in '98.
Can i get a ITIN and file next year and then start the AOS process after that?
Yes I have accumulated enough evidence about the marriage, my main concern is about...
I think it will be best to state your timeline to get a better advice....remember we are not attorneys
When did you enter? What visa? Do you still have your POE docs ie I-94, passport? Is your wife a USC etc....
Can I apply for one for next year's taxes? and then files for AOS after that?
Will that be okay? Just don't want to be on the IO's hot seat at the interview:)
I have been married for 8 years and my US spouse has not claimed me at all
due to NO SS#. I wanted to know if this would be a problem when applying
for AOS or at the interview?
We have 2 kids and he has been filing as Head of Household.
Thank you so much for your help.
