The NTA does put my brother-in-law in removal proceding however he's entitled to file for a green card based on "Cancellation of Removal". He's not a flight risk because he owns a company, a condo, few cars and he's the only caregiver for his gravely-ill USC parents.

Last week DHS agents arrested my brother-in-law in Chicago and detained him after serving him with NTA. He entered the US without inspection and his application for adjustment of status was denied late last year.
How can we bail him out?
