Was your TN to GC process succesfully completed?

That attorney left Fragomen and he no longer does WOM (prob because of the griefs I gave him over my misspelled name in court documents :)) Why would you want to hire him anyway? Hire Murthy Law Firm in DC. They are the WOM experts and charge almost half as much as Fragomen does. Ask for Aaron.

I-129 Premium Processing is it Risky

I did not have any problems with TN I-129 PP. My last two employers used to file PP whether for an extension or for a new TN for a new employer. One thing though: my new employer checked the box for "replacement TN" so I couldn't work for both employers at the same time. You can have multiple...

    DUI

I speak for experience. I do have a dismissed and expunged charge from over 20 years ago and CBP took me to secondary inspection every freaking time even though I showed them the court documents over and over, and the alleged crime wasn't even 10% as serious as a DUI. This was the case until one...

    DUI

Thanks for the correction. So it is pretty similar to an H-1B I129. Is its finalization at the border as easy as an H-1B's or does it get scrutinized by CBP since CBP has expertise in TN? My USCIS approved TN's never got scrutinized by CBP but I'm guessing that may not be the case for someone...

    DUI

    1. You've got it the the other way around: a TN I-129 can only be filed when you are in the US. If you're outside the US, you can apply for TN only at a POE. 2. Even if they dismiss the case, it will NOT go away for immigration purposes. All arrest records will show on CBP's computer screen even...

    DUI

Another advice: depending on the state where this happened, after and if you qualify for expungement, apply for it. This will NOT wipe it off your records for immigration benefits but it will wipe it off your records when an employer runs a background check on you. That is another problem you...

    DUI

Besides the advice of hiring lawyers ASAP (as in yesterday) that was already given to you, I'd also say not to cross the border in the near future and at least until your DUI case is resolved and the court has made a decision and you have paid all the fines and dues and jail time if any. CBP has...

GC from TN Visa through EB3

If you are finding other forums on this website kind of dead and you're not getting any response (I personally find other forums here kind of dead except for this one for TN), you can go to other websites like this one which is full of active members...

Green Card through TN..Is it possible for an Indian born?

I think the argument the lawyers sell to the employers is: if 485 is denied for whatever reason, the person can still fall on H/L and continue to work for the employer. But that argument kind of got weak over time as the odds of winning an H1 lottery became pretty slim. Otherwise, the ulterior...

Green Card through TN..Is it possible for an Indian born?

Forgot to mention why I said the above: I think that is the difference between being on a dual-intent (H or L) status when filing I-485 vs being on a non-immigrant status like TN. For example, you can get back into the US on H with a pending 485 (you wouldn't need AP) but that is not the case...

Green Card through TN..Is it possible for an Indian born?

Just to add to nelsona's response: while you are waiting for your very first EAD and Advance Parole after you have filed I-485, you cannot travel outside the US (and that includes trips to Canada). You must have the physical AP in your hand before you can travel, otherwise you risk your I-485 to...

USCIS I129 for First Time TN Applicant

Of course USCIS issued I-94's don't show up on USCBP's website. Since the CBP officer did not bother issuing an I-94 for you, you pretty much own a paper I-94 from USCIS. Why would you need an electronic one if you have a paper one? It seems like airport CBP are more strict because they always...

impact of moving from TN to H1B for spouse

It sounds like your company is NAFTA-phobic and/or they're scared NAFTA might get cancelled. Otherwise it makes absolutely no sense whatsoever to convert TN to H1. So what happens if you don't win the H1B lottery? Are they gonna lay you off?!! I'd be super cautious around an employer like that...

USCIS I129 for First Time TN Applicant

My experience post electronic I-94 has been this (multiple times, including an H1-B to TN conversion): I went to PFI USCBP with the approval notice in my hand and no old paper I-94 (because it was electronic) and even though the approval notice had an I-94, the officer stapled only the lower...

    H1B or EB-2

How would asking for H1-B help you with your GC? Two totally separate things! If you want a GC, first and foremost, your sponsor needs to file a PERM/Labor Certificate to prove there are no Americans with your skill set (that's where your 8 year experience and also education come into the...

Applying For TD when TN is almost expiring

Just a heads-up to expect longer than normal delays for EAD/AP applications. People are complaining about the backlog: http://www.trackitt.com/usa-discussion-forums/i485-eb/1810564431/ead-ap-pending-for-90-days/page/last_page Good thing you're taking care of renewing TN/TD first. But beware...

Applying For TD when TN is almost expiring

I agree with nelsona on PP for your I-129 because time seems to be of the essence in your particular case. Even if your employer does not cover the extra fee for PP, just pay for it out of your own pocket and don't be stingy about it.
