All,
I have a question and would appreciate if someone give reply. Once that I-130 Petition from National Visa center gets approve then how long do they take to issue a Visa Number; also do we need to file I-485 if the spouse is outside of US or else? Please advice...
Even within five years; USCIS have to go thru Immigration Judge OR Attorney General has the right to revoke it as per manual. After 5 years if they go to court then I assume it would be the Federal/District court like the DeNaturalization matter. Any comments?
As per USCIS Field manual if USCIS finds out that the Green card was obtained unlawfully then they could conduct the Rescission Process within 5years after its approval. After 5 years time-line how would USCIS proceed; please advice…
N-336 Info
Where do we mail the N-336 (Request for hearing for a Denial N-400); does it go to the geographical regions of residence of 4 service center or the National Benefit Center (MSC)? Please advice as it doesn’t have any address on the form instruction.
Don't get trapped and sign any paper until you get the OL. Interview means not necessarily they would send you Oath later. Stay steadfast until you get the full relieve.
So in your opinion; which method is the safest to file the "Proof of service"...By mail or by person. I can manage to do both without much problem involved...
Lazycis and other,
If we file the “Proof of Service” by person in court then do we need to ask for an evidence for that; I mean do I have to ask the clerk to put the received signature on the copy for my record. Please advice…
OK-Boy
Lazycis and others,
After mailing the original complaint to all the defendants and AUSA, do I have to send the subsequent requests (like MTD, MSJ, Motion for hearing, etc) to all the defendants OR just send a copy only to AUSA. Please advice…
OK-Boy
Service to AUSA
Lazycis and others,
Whatever we file in the court we need to send a copy to local US attorney; does it include the “Proof of Service” also the one we filed in court after the original complaint has been filed?
OK-Boy
MKA,
I'm disagreed with you about the initiation of the case; once the US attorney gets the complaint then the case kicks in. Offcourse we need to submit the "Proof of Service" in the court in order to get it going. Can others put their opinions on it....
Proof of service
Lazycis and others,
After filing the complaint do we need to submit the “Proof of Service” to court within 30 days or 120 days; does it vary from district to district?
OK-Boy
Don't drop it until you get the Oath Latter cuz their is no guarantee that USCIS would send you OL after IV. Don't worry, AUSA will send you a subject matter when he/she wants your sign on it but again be very careful in signing....
If you see under file number there is "A" mean they are asking for Alien number if she hasn't assigned it yet then leave it blank otherwise write down her A number...
You are absolute right; if you don't have that N-652 then You can't prove your interview cuz I assume that they took the IV letter. I wonder why you havn't gotten the N-652; maybe the DO was as confused as you were to get ya the form:)
I'm totally agreed with you and would like to say that if "you are not part of the solution then you are the part of the problem". Either give some good advice or stay quiet...
