Are you sure that you can do a cross-interlink? that is, you are currently a derivative on the 485...u now want to be the primary on the 485. Check with some attorney if this kind of interlink is possible...if not, you may have to file another 485.

I would use citations under "material about the alien". For scholarly work, I would use letters of reference to support my case. I think you stand a good chance - a very good chance at TSC, a fair chance at NSC.

sorry to hear that NW2 - was it Nebraska or Texas? I would not suggest appeal or MTR. You get stuck for a long time (a year or so) and the odds of success are not that great. Give it some time and re-apply.

I am not sure if OPT is dual-intent, maybe someone else can comment on that. If it is not, then dont do 485, do only 140. To be safe, I think it is better to get H1 and then apply EB1-EA via premium - get a response within 10 days, if favorable, then apply 485.

btw Brewtus, did you check processing dates for 485? It appears they are still stuck with 485s from 2007 September. Although your priority date is current, your processing date is not - which is probably why you are not seeing any action yet.

i did - sent in application on June 29th - got approval in 5 days. I wish I had done this in 2007 when they had it, but didnt. If you can spend the $1000, i would say do it before they remove premium processing. Thats my 2 cents.

i called NSC using the POJ method and spoke with an IO - he said my attorney needs to send a letter to NSC asking to interlink - cannot do it by phone. I think that is just BS. Have seen many people say they were able to get it done by phone. anyway, any one do it recently?
