    H4, divorce, custody

We recently got acquainted with a young Asian lady, who is here on H4 visa (has husband is on H1B). The marriage is not going well and she wants to divorce him and to return home. The problem is that they have a 2 years old daughter, born in USA, and this lady does not want to be separated from...

FYI: positive experience in GC correcting

Just thought I post it, for others to know that there is such a possibility. My mother recently got her Green Card, but there was a spelling mistake in her last name. I prepared I-90 (with supporting documents showing its USCIS fault etc.). But before sending it out I took my mother to the...

    Parent's Cases Only: Tracking Thread

We had the AOS interview for my mother today, February 27 2009, at Houston office. I accompanied her as a translator and petitioner (no questions were asked about that). The whole interview lasted 10 minutes, just several questions about some points in the forms. The officer explicitely...

    Parent's Cases Only: Tracking Thread

No. Once you get the Notice of Action about I-485 , their I-94 does not govern their stay anymore. Their status is "avaiting AOS" and it is legal as long as their case is being processed. You/them do not need to do anything.

I am applying for citizenship certificate (form N 600) for my son, who is 13 and lives with me. He came with me to US and then got Green Card through AOS as my dependent. I am naturalized US citizen. I have two questions, and I would very much appresiate any help. 1. On the form they ask...

AOS parent interview - do we need a lawer?

If anybody had an interview when applied for AOS for parent, could you tell what was your/your parent experience? My mother came as a tourist and then overstayed her visa for 7 months before I became citizen and applied for her (got stack in namecheck). I know this is forgiven, and she has a...

    Timeline for Parents' GC

Well, my mom was out of status for about 7 months before I got my citizenship and could file AOS for her. So no leaving US for her. On the other hand, it looks to me that if one were out of status for less then 6 months, and then applied for I-485 (and thus got in status again) then traveling...

    Timeline for Parents' GC

I applied for AOS for my mother in September (RD/ND was around mid-September). FP appointment was beginnig of October. She got EAD by the end of November (so we could apply for SSN for her). We did not apply for AP (she overstayed turist visa, so cannot leave USA before getting GC). No progress...

    expired fingerprints?

I applied for citizenship in February 2007 and got fingerprinted in March 2007. I finally got interview letter for mid-July 2008 (Houston office). But as far as I understand my fingerprints are already expired (validity is 15 months), - so it looks like after interview they will first ask me...

    Overstay B2?

As far as I remember, if you came to US on visa-vawer program (one which allows to come to US for up to 90 days as a tourist wisout applying for B visa), then you CANNOT change your status to any other status while in US and CANNOT get extention - you have to leave before your 90 days are...

2-nd N-400 to get around namecheck?

First of all, I did not say I would want to "abandon" my 1-st N-400. The fact of sending a second one in my opinion vould not automatically invalidate the first one. I believe that most probably both of them would be processed independently (given the usual mess in USCIS they probably will not...

2-nd N-400 to get around namecheck?

I applied for citizenship about a year ago, and as many here I am now stuck in namecheck. My application was on the basis of 5 years of residency. But my spouse is a (naturalized) US citizen for more then 3 years, and we are married for more then 3 years. Thus, I could now apply for citizenship...

Anyone with a lawsuit against USCIS or thinking about a lawsuit (Merged)

Dear all: My name check for naturalization is pending for almost a year. I know that it is probably too early to do anything, but I am really pressed by family matters. So I am thinking about going legal ways. Probably somebody could recommend me an attoney in Houston? Also, it seems to me I...

What's with the new law to eliminate FB?

Here are some numbers on family immigration in 2004 and 2006: http://www.dhs.gov/xlibrary/assets/statistics/yearbook/2004/table8.xls http://travel.state.gov/pdf/FY06AnnualReportTableVIII.pdf As far as I remember the total number of issued "parents immigration visas/grrencards" was about...

    N400 Timeline: Houston, TEXAS

US authorities would not contact your ambassy, put stamp in your passport or do anything like that. They just do not care. As far as I understand the only trouble is when you start to deal with your ambassy or travel to your home country and the moment comes when they ask you to produce a...

    DEAL reached on Immigration Bill

You lost me here. I was not making any argument. It all started when I wrote the following: "As far as I understand they propose to essentially kill family-based immigration: eliminate four of the current family preference categories (1, 2B, 3, and 4), and introdice quota for parents" And...

    Immigration reform what about family

As far as I know (I studied the subject, since I recently considered several offers outside USA) most of the developed countries do not allow immigration of siblings, but all allow immigration of old parents in one form or another. Majority do not have explicate "quotas" on parents immigration...
