My priority date is April 30, 2001 and I filed on October 18, 2006 and the application was denied on January 16, 2007. I was 25 when I applied, but I am a derivative of my fathers original visa petition and at the time his visa petition was approved, I was 20 years old.
the new memo is very clear about the CSPA now. I was denied for CSPA benefits because of the one year requirement, but according to this new memo, I should reapply. I am in the process of getting my forms together and will be sending them off to the USCIS next week.
I checked on the status of the I824 we filed back and February and finally on 5/23 it said they mailed out an RFE.. My question is, what on earth could they possibly want?! We mailed them the I824, a letter with my info on it requesting FTJ benefits and copies of all of my fathers documents...

Kamrans, I think I found the PDF you mentioned. I couldnt find it in this thread anywhere but I did some googling and came up with the state department cable where it indicates that posts must accept petitions from I-140 beneficiaries with the I-824 receipt...
I dont think it matters if they were born out of wedlock or not as long as they are her children she can apply to have them FTJ. There isnt a time limit either, as far as I know, as long as it's all initiated before they're 21. I did some research on the whole marraige vs out of wedlock thing...

The CSPA does apply in FTJ cases.. I've been doing lots of research on this because i'm in the same situation. The CSPA will apply if the I-824 was filed within 1 year of the VISA availability. Here's more information on it:

I just got 2 approval notice emails today for my I-765 application. I got an LUD on 11/2/2006 and then another 11/3/2006 saying my application has been approved and a card has been ordered. TSC approved it within 3 weeks, amazing... Now i'm still waiting on my 131 and 485....

I got my receipt notices in the mail today for the 485/765/131. They have a received date of October 16, 2006 and a notice date of October 19, 2006. I sent my stuff into NSC and it was transferred to TSC.
I havent gotten any mailed receipt notices yet but I did get the receipt numbers off the check images from my bank. My 485/765/131 ended up at Texas as well. I'm not sure if its a random thing how that happened or if its because the underlying petition i'm applying under was processed at the...
my checks were cashed on 10/20 for the 485/765/131. My bank doesnt have the images up yet, it should be on the site probably Monday. I still dont have any mailed receipt notices but once the check images are up i'll see what they have printed on them.
yes, I thought that the companies have to prove that they are paying the prevailing wage from the time of filing through the 485 adjudication? I thought the only time audited financial statements have to be provided is when the company is NOT paying the prevailing wage?
I sent in my 485/765/131 on Friday 10/13 with delivery confirmation and after tracking it, it shows it was delivered at 2:19AM on 10/16 (Today). We'll see what happens.

So i've decided to work with my HR person and just do the perm ourselves. I met with an attorney and its $3500 just for the perm or $5500 for the total perm/140/485 package. I cant afford that right now and i've been reading up on it, it doesnt seem like rocket science...
