Guys, Thought it is better to give you an update. I talked to AUSA today and we filed a joint stipulation of dismissal to the court. So the case will be dismissed by judge. It is a relief to me at last. Thank you guys for your great help!

It could be your NC happened to be cleared. I just figured it doesn't make sense there are no old cases being reported approved on trackitt.com if CIS does start approving cases that are approvable due to the demo. All recent approvals reported there are for 2006 & 2007 filers.

I don't think CIS has started approving EB AOS based on the memo. The recent approvals are either because of NC cleared or for family-based AOS. Just look at the recent approvals at trackitt. All approvals are those AOS filed in 2006 & 2007. If CIS has started approve cases based on the memo...

Given the fact that the demo applies to my case, I am thinking to write a motion to ask the court to compel USCIS to act on my case within a timeframe. Does anyone have a template? I would like to what format to use. Thanks.

Congrats!!! But I doubt you are the beneficiary of the Feb 4th Memo. If you really are, many other guys like me will need to worry - CIS is not keeping FIFO promise. I was clearly told several days back they'll process based RD order. Your NC was probably cleared.

I got the MTD from AUSA yesterday. I am reading it right now. I was told by AUSA that I have 21 days to respond but haven't heard anything from the court.
