Citizenship for wife (soon to be)

Although your situation is probably unique among people here, the procedure for getting your fiancee a green card (not citizenship yet) is the same as everyone else. I suggest you read up on the USCIS.gov website or maybe here...

    A few questions about I-94

Do with it what you wish. Scrapbook it, give it in when you leave the USA, roll it up and smoke it. It doesn't matter any more.

H1-B marriage to a US Citizen

Adjusting from an H-1B is a breeze. You can follow the instructions here: http://www.visajourney.com/forums/index.php?autocom=custom&page=i130guide2 and do it yourself without the expense of a lawyer. I personally did this. The important things you need to do right now is to schedule to...

Marrying US citizen while on B1-B2 need advice plz

They can technically deny your Green Card and deport you for entering with immigration intent on a B2 visa. Is it really worth it given the risks? I know it seems like the easy way out now, but you'll probably be wishing you went for the K-1 when you're paying $$$$ for an immigration attorney to...

"Technically you're not legal to be here" - huh?

Once upon entering the USA on my H-1B I was verbally dressed down by the CBP officer for having such a beat up passport. I don't know why he cared but I did take pains to tell him it was the result of the rule saying I must carry it on my person at all times, so what did he expect? ;)

"Technically you're not legal to be here" - huh?

Yes, but there is no equivalent to a Green Card for a naturalized US citizen.

"Technically you're not legal to be here" - huh?

I've often wondered this myself. As a brit whose lived here for 8+ years and not lost his accent, and am not about to even if I get US citizenship, how would I prove that I'm a US citizen if questioned?

"Technically you're not legal to be here" - huh?

CBP officers generally talk to you and expect responses!

"Technically you're not legal to be here" - huh?

Other than: Hey how come you've got a US Passport and an Australian accent?

"Technically you're not legal to be here" - huh?

Holy crap, I didn't notice that. Wait though, you were the thread starter right, how did you take 4 years to reply to that guy? ;)

"Technically you're not legal to be here" - huh?

Did you actually read his post? He didn't leave the USA. To the OP, you should probably carry a copy of the I-485 Notice of Action letter with you as well for proof that you are pending status. Really though there is no way of conclusively proving that you are in legal status unfortunately.

    Can we plan on traveling

You can get the I-551 stamp if your AOS is approved before you leave by making an Infopass appointment and asking for the stamp.

    Can we plan on traveling

If your AOS is not approved at interview, I can see no reason why they would "CWOP" your H-1B or take your I-94. Its not guaranteed that you will get an I-551 stamp. I asked for one and was told "we don't do those any more because Green Cards come in 2 weeks these days", of course then my...

    What went wrong?!?

USCIS themselves suggest that the immigrant's name be on their mailbox. If I find the document suggesting it I'll post it.

    Question about Filling for Citizenship

Yes, this is the wrong forum. Once she becomes a US citizen, she can file for AOS for you and you will be legal. Yes. Only when she becomes a US citizen though, until then you are not "safe". A question for the right forum. About 90 days after you file for it (along with your AOS).

    What went wrong?!?

Excellent advice. To the OP, I would suggest that their may be an issue with your mailing if you haven't got your welcome letter yet. Did you change address during the AOS process?

    Out of status

Yes! Yes, they all need to be filed together to the Chicago Lockbox in the same envelope. You obviously did misunderstand! It doesn't matter that your wife is out of status because that is "forgiven" if married to a US citizen. Yes, for both of you for the I-130, and for your wife for the i-485...
